HEARING QUANZHOU PEOPLE'S COURT IP CASE ED VAN DER HOEK

The 24th of April 2023 will be a historic date. At least in the life of Dutch artist Ed van der Hoek. But it will also mean a milestone in the juridical battle against theft of Intellectual Property in general. On the 24th a first  HEARING at the QUANZHOU PEOPLE'S COURT in the Chines Province of Fujian will take place.

EN : 4 more days until the start of the hearing in Quanzhou, China

The photo shows the courthouse where the case will take place. The photo was taken by one of the people affiliated with Lex Magister, an organization with 180,000 lawyers in its ranks.
In recent months, we have been working hard towards this first session. For the past week, my wife and I have been working feverishly to videotape the necessary statements.
The main pivot in the story are the people of the C.E.L.F., the China Europe Law Foundation, who may be able to bridge the gap to eventually provide legal assistance to more artists who are confronted with infringements of their Intellectual Property. Contrary to what people would have us believe, there is indeed respect for copyright in China and they are very willing to act against it. It is in everyone's interest that the Bern Convention from the 1930s is also observed in practice.
There is a lot of in-house knowledge on the subject in China, but few people have actually managed to come up with sufficient and adequate evidence.
We, I as an artist and the people of the CELF naturally hope that the infringers will be convicted.
This would allow us to continue our fight against illegal trade and in any case contribute to raising awareness of the fact that the artists who apparently make these products attractive to purchase are actually rewarded for these creative efforts.
I felt the tension rising in recent weeks and it is certainly important to get attention for this matter. Here on Instagram it may not be obvious to share messages, but I still hope that you as art lovers will also help me to give more publicity to the cause.
We as artists would like that. At least I might just have it high enough in my head to say this :)

NL : 24 april 2023 wordt een historische datum. Althans in het leven van de Nederlandse kunstenaar Ed van der Hoek. Maar het zal ook een mijlpaal betekenen in de juridische strijd tegen diefstal van Intellectueel Eigendom in het algemeen. Op de 24e zal een eerste hoorzitting plaatsvinden in de QUANZHOU PEOPLE'S COURT in de Chinese provincie Fujian.

De foto toont het gerechtsgebouw waar de zaak plaats gaat vinden. De foto is gemaakt door een van de mensen gelieerd aan Lex Magister, een organisatie met 180.000 advocaten in de gelederen.
De afgelopen maanden is hard naar deze eerste zitting toegewerkt. De afgelopen week zijn mijn vrouw en ik nog bezig koortsachtig bezig geweest om de nodige verklaringen op video te zetten.
De grote spil in het verhaal zijn de mensen van het C.E.L.F., de China Europe Law Foundation, die mogelijk een brug kunnen slaan om uiteindelijk meer kunstenaars die te maken hebben met inbreuken op hun Intellectuele Eigendom juridisch bij te kunnen staan. In tegenstelling tot wat men ons wil doen geloven is er in China wel degelijk respect voor auteursrechten en zijn zij ten zeerste bereid hier ook tegen op te treden. Het is in ieders belang dat de Conventie van Bern uit de jaren 30 van de vorige eeuw ook in de praktijk nageleefd wordt.
Er is in China veel kennis in huis over het onderwerp, maar het is maar weinig mensen daadwerkelijk gelukt met voldoende en adequaat bewijsmateriaal te komen.
Wij, ik als kunstenaar en de mensen van het CELF hopen uiteraard op een veroordeling van de inbreukplegers.
Daarmee zouden wij weer verder kunnen in onze strijd tegen de illegale handel en in ieder geval bijdragen in de bewustwording van het feit dat de kunstenaars die deze producten blijkbaar aantrekkelijk maken om aan te schaffen ook daadwerkelijk beloond worden voor deze creatieve inspanningen.
Ik voelde de laatste weken de spanning toch wel oplopen en het is zeker ook zaak om aandacht voor deze zaak te krijgen. Hier op Instagram ligt het misschien niet zo voor de hand om berichten te delen, maar toch hoop ik dat jullie als liefhebbers van kunst me toch ook een beetje willen helpen meer ruchtbaarheid aan de zaak te geven.
Dat zouden wij als kunstenaars best willen. Tenminste ik heb het misschien net hoog genoeg in mijn bol om dit namens de alle kunstenaars te kunnen zeggen : )
